Tax ID and the NTAA Explained
Do you need a Tax ID for your bank account?
- You don’t need a Tax ID unless you fall under categories defined by the Nigeria Tax Administration Act (NTAA).
- NTAA mandates Tax Identification Numbers (Tax IDs) for certain transactions, especially for taxable persons.
1. Must everyone obtain a Tax ID before operating a bank account?
- Yes, but with exceptions.
- Section 4 of the NTAA says taxable persons must obtain a tax ID.
- A taxable person = anyone earning income through trade, business, employment, or any economic activity.
- Banks must request a Tax ID from taxable persons only.
- Students, dependents, or individuals with no income are exempt.
2. Is this a new rule?
- No.
- Requirement has existed since the Finance Act 2020, which amended Section 49 of the Personal Income Tax Act.
- Since January 2020, anyone running a business bank account must have a TIN.
- NTAA simply provides a unified legal framework to harmonize identities and simplify tax compliance.
3. Why use “Tax ID” instead of “TIN”?
- “Tax ID” is a unified term to eliminate multiple numbers issued by different agencies (FIRS, JTB, State IRS).
- In the future:
- NIN → Tax ID for individuals
- CAC number → Tax ID for companies
- Reduces duplication and makes compliance easier.
4. If I already have a TIN, do I need a new Tax ID?
- No.
- Your existing TIN remains valid—no need for re-registration.
5. Do you need to queue or do biometrics for Tax ID?
- No biometrics required.
- Tax ID is not a physical card—just a unique number linked to your identity.
- Apply free online via tin.jtb.gov.ng or visit FIRS / State IRS / JTB office.
- Do not pay touts.
6. What about businesses?
- All businesses must have a Tax ID.
- For small, unregistered businesses → use your personal Tax ID.
- For companies, NGOs, incorporated trustees → a TIN is automatically generated during CAC registration.
- If registered long ago without a TIN → apply online or visit FIRS with CAC documents.
7. Nigerians in the Diaspora
- Nigerians abroad with business or income-linked Nigerian bank accounts can obtain a Tax ID using their NIN.
- If the bank account is not used for income or business, no Tax ID is required.
8. Foreign companies doing business in Nigeria
- Must obtain a Tax ID if they operate or supply goods/services in Nigeria.
- Non-resident companies earning passive income (dividends, royalties) may not need to register but must supply required details.
- Companies effectively managed from Nigeria are treated as Nigerian residents and must comply.
9. Are government agencies exempt?
- No.
- Section 5 of the NTAA: All MDAs and government-owned enterprises at every level must obtain a Tax ID.
10. What happens if a taxable person does not register by Jan 1, 2026?
- This is not a new requirement—most taxable persons already comply.
- A taxable person without a Tax ID may later face difficulties operating bank accounts.
- Exemptions still apply to low-income individuals, dependents, and non-earners.
